Electromagnetic Geoservices (EMGS) and Offshore Hydrocarbon Mapping (OHM) have agreed to settle proceedings in which EMGS alleged infringement of and threats to infringe its patent GB 2382875 relating to one aspect of its proprietary seabed logging technology. As part of this agreement OHM has undertaken not to infringe the patent. EMGS has a broad portfolio of patents and patent applications in more than 25 jurisdictions relating to its seabed logging technology.
The agreement does not limit EMGS' ability to defend any of its patents against infringement by OHM.
"We are very satisfied with OHM agreeing not to infringe our patent. We have not been presented with any data to refute our belief that they had infringed our patent, and we continue to believe that they did. We will vigorously enforce our patents in the future," said Terje Eidesmo, Chief Executive Officer of emgs.
The proceedings were launched by EMGSin October 2006 in the High Court of London.
OHM filed evidence with the Court seeking to demonstrate that EMGS was mistaken in its belief that OHM's activities were infringing.
Dave Pratt, OHM’s Chief Executive Officer, said, “We have consistently stated that we were not infringing the patent in question. We are very pleased that EMGS has dropped this time-consuming action. We will now continue with our business as normal.”
